JUST FILED! CITIZEN PETITION FOR IMMINENT HAZARD RULEMAKING TO THE FDA AND HHS
On December 20, 2021, BBILAN and BALANCE GROUP attorneys filed a Petition to the HHS and FDA, on behalf of Americans for Responsible Technology (ART), Environmental Health Trust, and other parties, to promulgate rules declaring that the present state of regulatory uncertainty and ambiguity over whether the FDA has promulgated RF/EMF radiation safety standards is presenting an Imminent Hazard to public health. The Petition proposes specific rules to address and to correct the problem. The Imminent Hazard Petition is the foundation of a series of subsequent rulemaking petitions to the FDA focusing on specific devices, vulnerable populations, and conditions. Petitioners urge the HHS/FDA, as the principal health authority in the U.S., to clarify its official RF radiation safety policy so that other federal agencies and international health authorities, the Congress, and the general public can rely upon it.
